TERMS AND CONDITIONS OF SALE
These terms and conditions apply to the purchase of products from TEKNIK, operated by TEKNIK AUS, ABN 53 246 568 264.
1. ACCEPTANCE OF TERMS
By placing an order through our website, you agree to be bound by these terms and conditions, our Privacy Policy, and any additional terms that may apply. If you do not agree with any part of these terms, you must not proceed with your order.
2. ORDERS
2.1. Order Placement: When you place an order, you are making an offer to purchase the selected products in accordance with these terms.
2.2. Order Confirmation: We will send you an order confirmation email detailing the products you have ordered. This email is not an acceptance of your order, but a confirmation that we have received it.
2.3. Acceptance of Order: Your order is accepted, and a contract of sale is formed, only when we dispatch the products to you and send a dispatch confirmation email. We reserve the right to refuse or cancel an order at any time for certain reasons including but not limited to: product availability, errors in product information, or an error in your order.
3. PRICING & PAYMENT
3.1. Prices: All prices listed on our website are in Australian Dollars (AUD) and include Goods and Services Tax (GST) unless stated otherwise. Prices are subject to change without notice.
3.2. Payment: Payment must be made in full at the time of placing your order. We accept payment via Credit card, PayPal, Apple Pay and Shop Pay.
4. DELIVERY
4.1. Delivery Times: We will use reasonable efforts to deliver your order within the estimated delivery timeframes provided on our website. However, these timeframes are estimates only and delays can occur.
4.2. Risk and Title: Risk of loss or damage to the products passes to you upon delivery. Title to the products passes to you upon full payment of the purchase price.
5. RETURNS & REFUNDS
5.1. Consumer Guarantees: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
5.2. Refunds and Returns Process: If you believe a product is faulty or does not meet consumer guarantees, please contact us at info@teknikaus.com within 30 days of receiving your order. We will provide instructions on how to return the product and will cover the costs associated with return postage. Upon receipt of the returned product, we will examine it and notify you of your entitlements under the Australian Consumer Law.
5.3. Change of Mind: We may, at our discretion, offer a refund or exchange for change of mind returns within a reasonable time and provided the product is returned in its original condition with proof of purchase.
6. PRIVACY
6.1. Collection of Information: We collect personal information in accordance with our Privacy Policy to process your order and for other specified purposes. By providing your personal information, you consent to its collection, use, and disclosure in accordance with our Privacy Policy.
7. LIMITATION OF LIABILITY
To the extent permitted by law, our liability for breach of any implied warranty or condition that cannot be excluded is limited to the replacement of the goods or the supply of equivalent goods, or the payment of the cost of replacing the goods or acquiring equivalent goods.
8. CONSUMER GUARANTEES
In accordance with the Australian Consumer Law, our goods come with guarantees that cannot be excluded. 9. GOVERNING LAW
These terms and conditions are governed by the laws of the State of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction.
10. CHANGES TO TERMS
We reserve the right to amend these terms and conditions at any time. Any amendments will be effective immediately upon posting on our website. Your continued use of our website following such amendments constitutes your acceptance of the amended terms and conditions.
